By downloading, installing, copying, or otherwise using the Interactive Drape (hereafter known as the SOFTWARE, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not download, install or use the SOFTWARE.
The SOFTWARE, including all related files, together with the accompanying documentation (collectively known as the “SOFTWARE”) is owned by Steven Hancock and is protected by copyright laws and international treaties. Therefore, the SOFTWARE must be treated like any copyrighted material.
Steve Hancock and Interactive Prototyping grants any user the limited right to use the software in the manner set forth in this agreement. The following restrictions apply:
You may not:
- make or distribute copies of the SOFTWARE.
- charge any fees for either the distribution or the use of the SOFTWARE.
- rent or lease the software to any party
- represent in any way that you are selling the SOFTWARE.
- distribute any portion of the SOFTWARE or any derivative of any portion of the SOFTWARE in any form.
- decompile, disassemble or reverse engineer any portion of the SOFTWARE.
- expose the interfaces of the SOFTWARE through your application (e.g. an OCX, DLL, class library, etc..)
- use the SOFTWARE to perform any unauthorised or illegal activity.
Steven Hancock and Interactive Prototyping expressly disclaims any warranty for the SOFTWARE. THE SOFTWARE AND ANY RELATED DOCUMENTATION IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE SOFTWARE REMAINS WITH YOU.
Steven Hancock and Interactive Prototyping do not warrant, guarantee or make any representations regarding the use, or the results of use of the SOFTWARE or written materials in terms of correctness, accuracy, reliability or otherwise. The Licensee assumes the entire risk with regard to the use of the SOFTWARE and any results from the use of the SOFTWARE.
Steven Hancock and Interactive Prototyping do not warrant that the SOFTWARE will meet any expected requirement, that operation of the SOFTWARE will be uninterrupted or error-free, or that any software errors will be corrected. Steven Hancock and Interactive Prototyping are not responsible for problems caused by changes in the operating characteristics of computer hardware or computer operating systems which are made after the release of the SOFTWARE nor for problems in the interaction of the SOFTWARE with other software. Steven Hancock and Interactive Prototyping will have no responsibility to replace or refund any license fee or cost of equipment damaged by accident, abuse or misapplication of the SOFTWARE.
The SOFTWARE is intended for private, commercial, institutional, and industrial users. The above warranties are exclusive and in lieu of all other warranties, whether expressed or implied. No oral or written information or advice given by Steven Hancock and Interactive Prototyping, its employees, distributors, dealers or agents shall increase the scope of the above warranties or create any new warranties. Neither Steven Hancock and Interactive Prototyping nor anyone else who has been involved in the creation, production or delivery of the SOFTWARE shall be liable for any direct, indirect, consequential or incidental damages, including damages for loss of business profits, business losses, business interruption, loss of data, and the like, arising out of the use or inability to use the SOFTWARE, or any other claim by any party even if Steven Hancock or Interactive Prototyping have been advised of the possibility of such damages.
